1. Introduction & Acceptance
These Terms of Service ("Terms") govern your use of the TrackMyRMC platform (trackmyrmc.com) operated by Aakruti Infra RMC ("we", "our", or "us"). By accessing or using our platform — including the web app, PWA, or any associated services — you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the platform. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
2. Definitions
- •"Platform" refers to the TrackMyRMC web application, PWA, and all related services.
- •"User" refers to any person or entity accessing or using the platform, including Plant Managers, Supervisors, Drivers, Clients, and Accounts staff.
- •"Account" refers to the registered profile a User creates to access the platform.
- •"Content" refers to all data, text, files, images, and materials uploaded or generated through the platform.
- •"Services" refers to all features provided including order management, GPS tracking, challan generation, invoicing, notifications, and reporting.
3. Eligibility
You must be at least 18 years old to use our platform. By using the platform, you represent and warrant that:
- •You are at least 18 years of age.
- •You have the legal capacity to enter into a binding agreement.
- •You are using the platform for legitimate business purposes related to Ready Mix Concrete operations.
- •All information you provide during registration is accurate, complete, and current.
4. Account Registration & Security
- •You must provide accurate and complete information when creating an account.
- •You are responsible for maintaining the confidentiality of your login credentials (email, OTP, PIN).
- •You are responsible for all activities that occur under your account.
- •You must immediately notify us of any unauthorised access to your account.
- •We reserve the right to suspend or terminate accounts that violate these Terms.
- •Plant Managers may create and manage sub-accounts for Drivers, Supervisors, and other staff.
5. Permitted Use
You agree to use the platform only for lawful purposes and in accordance with these Terms. You may:
- •Manage concrete orders, challans, and deliveries.
- •Track fleet vehicles and driver GPS location during active trips.
- •Generate and share invoices, challans, and delivery reports.
- •Communicate with team members through in-app chat and notifications.
- •Access analytics, reports, and AI insights for operational improvement.
6. Prohibited Conduct
You agree NOT to:
- •Use the platform for any illegal purpose or in violation of any applicable laws.
- •Attempt to gain unauthorised access to any portion of the platform or other users' accounts.
- •Use GPS tracking or remote access features for purposes unrelated to legitimate business operations.
- •Transmit viruses, malware, or any code designed to disrupt or harm the platform.
- •Reverse engineer, decompile, or disassemble any part of the platform.
- •Scrape, data-mine, or systematically extract data from the platform.
- •Share your account credentials with unauthorised persons.
- •Use the platform to harass, threaten, or discriminate against any person.
- •Misrepresent your identity or affiliation with any person or organisation.
- •Interfere with or disrupt the integrity or performance of the platform.
7. GPS & Location Tracking
Our platform includes GPS tracking features for fleet management. By using these features, you acknowledge:
- •GPS tracking is activated only during active trips when a Driver starts Driver Mode.
- •Location data is used for delivery tracking, route optimisation, and theft prevention.
- •Drivers consent to GPS monitoring during working hours as a condition of using the platform.
- •GPS data is shared with authorised Plant Managers and relevant Clients for delivery tracking.
- •The diesel theft alert system uses GPS proximity detection near the plant fuel zone.
- •Location accuracy depends on device hardware and network conditions — we are not responsible for inaccuracies.
8. WhatsApp & Communication
By providing your mobile number, you consent to receiving operational notifications via:
- •WhatsApp Business messages (order updates, delivery alerts, payment reminders).
- •Push notifications (if enabled on your device).
- •In-app notifications and chat messages.
- •You may opt out of non-essential notifications by contacting your Plant Manager or support.
- •Transactional notifications (order confirmations, security alerts) cannot be disabled while your account is active.
9. Intellectual Property
- •The platform, including its source code, design, features, and documentation, is the property of Aakruti Infra RMC and Gold-e TECH App.
- •You retain ownership of the business data and content you upload to the platform.
- •You grant us a non-exclusive licence to use your uploaded content solely to provide and improve our services.
- •Our trademarks, logos, and brand elements may not be used without prior written permission.
- •Generated challans, invoices, and reports may be freely used by you for your business purposes.
10. Payment & Billing
- •Access to the platform may require a paid subscription after the trial period expires.
- •Pricing, plans, and payment terms are displayed on our pricing page and may change with 30 days' notice.
- •All fees are in Indian Rupees (₹) unless otherwise stated.
- •Failure to pay outstanding fees may result in account suspension or restricted access.
- •Refunds are handled on a case-by-case basis at our discretion.
11. Data Ownership & Portability
- •You own all business data (orders, challans, invoices, client records) you create on the platform.
- •You may request a data export at any time through the platform or by contacting support.
- •Upon account deletion, we will provide a data export and then delete your personal data within 30 days, subject to legal retention requirements.
- •Certain records (challans, invoices) may be retained longer to comply with GST and accounting regulations.
12. Account Deletion
You may request account deletion at any time through the Settings page or by contacting support. Upon deletion:
- •Your personal data will be permanently deleted within 30 days.
- •A final data export will be made available before deletion.
- •Business records required for legal compliance (GST invoices, challans) will be anonymised and retained as required by law.
- •Active subscriptions will be cancelled with no refund for the remaining period.
- •Deletion is irreversible — once processed, your data cannot be recovered.
13. Service Availability & Disclaimers
- •We strive for 99.9% uptime but do not guarantee uninterrupted service.
- •The platform is provided "as is" without warranties of any kind, express or implied.
- •We are not liable for losses due to network failures, device issues, or third-party service outages.
- •AI Insights and recommendations are for informational purposes only — business decisions remain your responsibility.
- •GPS accuracy, WhatsApp delivery, and push notification reliability depend on external factors outside our control.
14. Limitation of Liability
To the maximum extent permitted by Indian law:
- •Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
- •We are not liable for indirect, incidental, special, consequential, or punitive damages.
- •We are not responsible for losses resulting from unauthorised access to your account due to your failure to secure credentials.
- •We are not liable for business losses, lost profits, or operational disruptions caused by platform downtime.
15. Indemnification
You agree to indemnify and hold harmless Aakruti Infra RMC, its officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, misuse of the platform, or infringement of any third-party rights.
16. Termination
- •You may terminate your account at any time by requesting deletion.
- •We may suspend or terminate your account for violation of these Terms with or without notice.
- •Upon termination, your right to use the platform ceases immediately.
- •Provisions that by their nature should survive termination (IP, liability, indemnification) will continue in effect.
17. Governing Law & Dispute Resolution
- •These Terms are governed by the laws of India.
- •Any disputes shall be subject to the exclusive jurisdiction of the courts in Navi Mumbai, Maharashtra, India.
- •Before filing any legal action, parties agree to attempt resolution through good-faith negotiation for 30 days.
- •For disputes below ₹10,00,000, parties agree to binding arbitration under the Indian Arbitration & Conciliation Act, 1996.
